Why do you need a will?
In the event of your death you want to be sure that your loved ones are provided for in the manner that you would like. You may have specific items that you would like to leave to a certain person or their may be certain wishes that you may want to convey. There is a general misconception that if you do not have a will all of your assets will go to the Commonwealth of Pennsylvania. In fact, there are statutes that determine where your assets will go if you do not have a will. Only in rare situations do your assets go to the Commonwealth. However, these rules of intestacy do not take your wishes into consideration.
What do I need to think about in preparing my will?
You should consider who you want to administer your estate. This person with the help on a qualified attorney will be responsible for seeing that your wishes in your will are carried out, pay your last debts and funeral expenses and see that all of your assets are gathered and taxes are paid. This person is call your executor or executrix. You should also think about who you want to leave your assets to and whether you have minor children who will need a guardian in the event of your death or the death of your spouse.
What happens if I do have minor children?
If you have minor children you should carefully consider who you want to care for them in the event that you or your spouse should die. This person would be named as the testamentary guardian in you will. You may also wish to consider naming a trustee to handle assets for you children if they are minors upon your death. Of course, you should consult with the people that you have in mind, you do not want this responsibility to come as a suprise to them.
Where should I keep my will?
It is best to keep your will at home in a fire proof box or safe or at your attorney's office in his or her will safe. A safe deposit box at the bank is not the best choice as it is not readily accessible in the event it is needed.
