When an Estate is opened a request is filed with the Register of Wills and Letters Testamentary or Letters of Administration are granted naming a certain individual(s) as the fiduciary of the estate. If a will names a certain individual(s) as Executor they may become the fiduciary. In cases where there is no will the Court may appoint someone to be the Administrator of the estate. The Executor or Administrator is known as the fiduciary. It is the responsibility of the fiduciary to administer the estate and to account to the Court for that administration. Due to the complexity of the law and the legal problems that may arise in estate administration we strongly suggest that all fiduciaries seek legal counsel.
